AES will experience a 78-hour outage during the cutover of the AES
Redesign requirements. The outage will take place from 12:01 AM EDT
June 5, 2004 (Saturday morning) to 06:00 AM EDT June 8, 2004
(Tuesday morning).
During this outage, the AES queues will be down, thus preventing
incoming transmissions from being received and outgoing messages from
being generated.
Please follow the instructions for filing during this outage. The
instructions appear below under the following headings:
1. For No License Required (NLR), EAR-99 and non-licensed items on
the Commerce Control List (CCL)
2. For ALL shipments Licensed by any Government agency and ALL items
on the USML
3. For Emergency USML items ONLY (as defined in the ITAR 123.22)
4. For Emergency BIS License Shipments ONLY

1. For No License Required (NLR), EAR-99 and non-licensed Items on
the Commerce Control List (CCL):
The Customs and Border Protection (CBP) requires that all filers
transmit these types of transactions no later than 11:59 PM EDT
Friday June 4, 2004 for shipments exporting on Saturday, Sunday, and
Monday if complete information is available. Any transactions that
cannot be filed by Friday for these shipments, must follow the
interim downtime policy below.
INTERIM DOWNTIME POLICY
Cite the following exemption statement on the air waybill, bill of
lading, or other commercial documentation: "AES" followed by the
external transaction number (XTN) (filer's 9-position ID number
followed by a dash and the shipment reference number).
For example: AES 222256789-MIA12345
Once AES is back up on Tuesday morning, all AES transactions for
shipments that moved under the downtime policy must be filed along
with any new AES transactions.

2. For ALL shipments Licensed by any Government agency and ALL items
on the USML:
CBP requires that any of these transactions be filed no later than
4:00 PM EDT June 4, 2004. If the shipment is not considered an
emergency (see below) and cannot be filed by 4:00 PM EDT June 4, 2004,
then the licensed or ITAR shipment cannot be exported during the AES
Outage.

3. For Emergency USML items ONLY (as defined in the ITAR 123.22):
123.22(b)(2) For Emergency USML shipments that cannot meet the pre-
departure filing requirements, CBP may permit an emergency export of
hardware by truck (departures to Mexico or Canada) or air by a U.S.
registered person, when the export departing the United States
June 5 - 7, 2004 is unable to comply with the AES pre-departure
filing by 4:00 p.m. EDT, Friday June 4, 2004.
The applicant or agent acting on behalf of the applicant's behalf,
must provide a paper SED to the CBP at the port of export and a copy
of a notification to DDTC stating that the shipment is urgent and why.
The original of the notification must be immediately provided to DDTC.
The SED filing when the export is by air must be at least two hours
prior to any departure from the U.S.; and when a truck shipment, at
the time when the exporter provides the articles to the carrier or at
least one hour prior to the departure from the U.S.

4. For Emergency BIS License Shipments ONLY:
For emergency exports of merchandise under a BIS License, such as a
production line down, or a grounded aircraft, the filing must be made
on a paper SED if the filing was not made prior to 4:00 EDT on Friday
June 4, 2004 in AES.
