From: Nick Orsini, Chief, Foreign Trade Division
Subject: Additional Mandatory AES Filing Requirements in 15 CFR 30.2(a)(1)(iv) of the Foreign Trade Regulations for Exports Identified in the Export Administration Regulations §758.1(b)

This letter provides additional requirements in §30.2(a)(1)(iv) of the Foreign Trade Regulations for filing of electronic export information through the Automated Export System (AES) for export shipments that the Bureau of Industry and Security requires under §758.1(b) of the Export Administration Regulations (EAR).  Specifically, any shipment identified under §758.1(b) of the EAR must be reported in the AES regardless of value or destination.  Every effort must be made by the U.S. Principal Party in Interest or its U.S. authorized agent to comply with this requirement.

If you have questions concerning this requirement, please contact the Regulations, Outreach, and Education Branch, FTD on (800) 549-0595, option 3, or by e-mail using FTDRegs@census.gov. For additional information on the filing requirements contained in §758.1 of the EAR, please visit www.bis.doc.gov or contact them on (202) 482-4811.
